How jure matrimonii works...
Obtaining Italian citizenship by marriage—also known as jure matrimonii—is a process that allows spouses of Italian citizens to become Italian citizens themselves. While the process involves careful preparation and strict requirements, it opens the door to a new life in Italy and the European Union.
It’s a meaningful journey that grants you the rights and privileges of Italian citizenship, including the ability to live, work, and travel freely throughout the EU.
Here’s a general overview of the steps involved in obtaining your citizenship through jure matrimonii:
Step 1: Confirm your eligibility
Before starting your application for Italian citizenship through jure matrimonii, it’s essential to make sure you meet the eligibility requirements. At the most basic level, eligibility is typically based on these criteria:
- You are legally married to an Italian citizen.
- You have been married for at least two years if living in Italy, or three years if living abroad.
If you and your spouse have children together (biological or adopted), the required time is reduced by half (one year in Italy, one and a half years abroad).
- Your marriage is officially registered with the Italian authorities.
- You hold a B1-level Italian language certification from an approved institution.
- You have no serious criminal convictions.
These are the main requirements; individual circumstances or local authorities may require additional documentation or steps.
Step 2: Gather your documents
You’ll need to collect several official documents to support your application for Italian citizenship through JM. This process can take time, so it’s important to plan ahead and ensure each document meets the requirements.
In addition to standard vital records such as birth certificate, proof of residence, and marriage record—the marriage must be registered with Italian authorities—citizenship through marriage has two additional document requirements:
- B1-level Italian language certification
- This must be obtained from an officially recognized institution. It does not need to be issued within the last six months to be accepted.
- Background checks
- You’ll need background checks from every country (and, if applicable, every U.S. state) in which you have lived since age 14.
Be sure to check the specific requirements of your local Italian authority, as they may request additional documents or details. Gathering these documents carefully and ensuring they are up-to-date (usually issued within the last six months) will help prevent delays in your application. Submitting documents older than six months can result in delays or rejection, so careful timing is essential.
Note that all non-Italian documents must be translated by a court-registered translator and sworn before the court. They must also be legalized with an apostille from the relevant authority.
Step 3: Apply for recognition
Once you have gathered all your documents, you’ll submit your application and all required documents through the official online portal. Note that this portal is entirely in Italian and requires a verified digital identity to access. After submission, your application will be reviewed by the applicable Italian authority based on where you reside: the questura and prefettura.
After applying, you’ll receive official communication at various points in the process. These communications may include requests for additional information or documents, in which case you’ll have a very limited window of ten days to respond with the requested information.
After your application is reviewed, you’ll receive notice of acceptance or rejection of your application. If approved, you’ll be invited to the comune or consulate for a swearing-in ceremony, after which you can officially request your Italian passport.
Step 4: Receive your Italian passport
Once your application for citizenship through JM is approved and you’ve completed the swearing in—congratulations! You are now officially an Italian citizen. You’ll have full access to all the rights and privileges of Italian citizenship, including applying for your Italian passport at your local comune or consulate.
